3. Account Registration

Certain features of BG Sports Agent may require creation of a user account.

Users agree to provide accurate, current, and complete information when creating or maintaining an account.

Users are responsible for protecting their account credentials and for activity that occurs under their account.

You should notify BG Sports Agency promptly if you believe your account has been accessed or used without authorization.

4. Eligibility and Minor Users

BG Sports Agent may include users under the age of 18 in connection with legitimate athlete-management, scouting, communication, or sports-related activities.

Parents or legal guardians are encouraged to review these Terms and our Privacy Policy when a minor uses BG Sports Agent.

5. Acceptable Use

Users agree not to use BG Sports Agent to:

• Submit false, deceptive, fraudulent, or misleading information
• Impersonate another person or misrepresent an affiliation
• Attempt to gain unauthorized access to another account, system, or network
• Upload malicious code, malware, or harmful software
• Disrupt, interfere with, or damage BG Sports Agent or its infrastructure
• Use automated methods to scrape, copy, or improperly extract application content or data
• Use information obtained through BG Sports Agent for unlawful or unauthorized purposes
• Engage in activity that places BG Sports Agency, athletes, clients, or other users at unreasonable legal or security risk

6. Athlete and Client Information

Users may have access to athlete, client, scouting, branding, or business information through BG Sports Agent depending on their role and permissions.

Users agree to access and use such information only for authorized purposes.

Information concerning athletes, clients, or other users may not be copied, distributed, disclosed, sold, or otherwise used outside the scope of authorized activities without appropriate permission or legal authority.

7. No Guarantee of Representation or Opportunity

Access to or use of BG Sports Agent does not by itself create an agency, representation, employment, sponsorship, endorsement, scholarship, recruiting, NIL, or other contractual relationship.

Any such relationship must be established through a separate agreement, contract, or other applicable process.

BG Sports Agency does not guarantee athletic opportunities, scholarships, contracts, endorsements, sponsorships, roster positions, professional representation, NIL compensation, or other outcomes through use of the application.

8. User Content

Users may be permitted to submit profile information, messages, images, statistics, documents, or other content through BG Sports Agent.

Users are responsible for ensuring that they have the right to submit any content they provide.

By submitting content, users grant BG Sports Agency permission to store, process, display, and use that content as reasonably necessary to operate the application and provide related services.

Users retain any ownership rights they may have in their original content unless otherwise agreed in writing.

9. Intellectual Property

BG Sports Agent, the BG Sports Agency name, logos, branding, software, designs, text, graphics, interfaces, and other proprietary materials are owned by or licensed to Buff Ginger Sports Agency and Branding, LLC unless otherwise stated.

Users may not reproduce, modify, distribute, sell, license, reverse engineer, or create derivative works from protected application content except as permitted by law or with prior written authorization.

10. Third-Party Services

BG Sports Agent may use or link to third-party services, websites, platforms, software, or technology providers.

BG Sports Agency is not responsible for the independent terms, privacy practices, availability, security, or content of third-party services.

11. Application Availability

We aim to keep BG Sports Agent available and functional, but continuous or uninterrupted access is not guaranteed.

The application may be unavailable temporarily due to maintenance, updates, technical issues, service-provider outages, security concerns, or circumstances beyond our control.

Features may be modified, suspended, replaced, or discontinued when reasonably necessary.

12. Account Suspension and Termination

BG Sports Agency may suspend, restrict, or terminate access to BG Sports Agent when reasonably necessary to address:

• Fraudulent or abusive activity
• Unauthorized access or security threats
• Misuse of athlete, client, or agency information
• Legal or regulatory requirements
• Conduct that creates material risk to BG Sports Agency or other users

13. Disclaimer of Warranties

BG Sports Agent is provided on an "as available" and "as is" basis to the extent permitted by law.

Buff Ginger Sports Agency and Branding, LLC does not guarantee that the application will always be uninterrupted, error-free, secure, or suitable for every user's particular purpose.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Buff Ginger Sports Agency and Branding, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of or inability to use BG Sports Agent.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15. Privacy

Use of BG Sports Agent is also subject to our Privacy Policy, which explains how personal information may be collected, used, protected, retained, and disclosed.
